We work with municipalities, developers, industrial manufacturers, drycleaners, property owners, and business owners facing lawsuits or regulatory demands for environmental contamination, including perfluoroalkyl and polyfluoroalkyl substances (PFAS). We find old policies to help to pay for legal defense, investigation and remediation, and site redevelopment.
We conduct Confidential Insurance Archeology to find old Commercial General Liability (CGL) policies that will provide money to answer these long-tail property damage claims. We conduct Potentially Responsible Party searches to identify past owners and operators who may have contributed to or caused contamination and share in the liability. We conduct Corporate History Research to reconstruct the responsible party’s historical insurance coverage, so the regulatory claim can be tendered to insurance carriers. We conduct an Insurance Policy Audit to evaluate the policies businesses have in their possession and determine which policy years are missing. We maintain an extensive Specimen Policy Library to ground truth evidence of coverage and help reconstruct potentially missing portions of policies.
Understanding historical land use, business ownership, and insurance coverage can limit the liability of individuals and their carriers and initiate coverage from additional policies. This creates a complete insurance portfolio of assets that can be assembled to create a larger reservoir of monies for equitable allocation.
